- Definitions
“Product” means the equipment, parts, materials, supplies and other goods that we are providing to you pursuant to your purchase.
“Service” means the performance of a task or access to a resource or any other services that we have agreed to perform pursuant to your order.
- Orders, Price and Payment
Payment for the Products and Services shall be made in full before the delivery of the Products or provision of the Services. You agree to pay the amounts as agreed, including any applicable goods and services, sales, use or similar taxes, fees or duties, any late payment fee and shipping charges. You are responsible for any applicable taxes for each Product from the date we ship it to you or when the Service is provided.
Prices listed on our website are subject to change without any prior notice. We reserve the right to change prices for products displayed at/on the Site at any time, and to correct pricing errors that may inadvertently occur. In the event of a pricing error, we will notify you of the error and allow you to either proceed with the transaction at the correct price or cancel your order at no cost to you.
We may, in our sole discretion, refuse or cancel any order and limit the order quantity. We may also require additional qualifying information prior to accepting or processing any order. Once we receive your order, we will provide you with an email order confirmation. We reserve the right, in our sole discretion, at any time after receiving your order or after sending you an order confirmation to decline your order for any reason. If we cancel an order after you have already been billed, we will refund the billed amount to you with no further obligations or liabilities whatsoever.

- Product Availability and Limitations
Given the popularity and/or supply constraints of some of the products, we may have to limit the number of products available for purchase. We reserve the right to change quantities available for purchase at any time, even after you place an order. Furthermore, there may be occasions when we confirm your order but subsequently learns that we cannot supply the ordered product. In the event we cannot supply a product you ordered, we will cancel the order and refund your purchase price with no further obligations or liabilities whatsoever.
- Warranty
All Products are sold only with the warranties provided by the manufacturer of the Products, if any. We make no other warranty with respect to the Products and disclaim any and all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
The warranties with respect to a Product sold shall be as stated in your order for the relevant Product, save for the following:
- No condition is made or to be implied nor is any warranty given or to be implied as to the life of the Products supplied or that they will be suitable for any particular purpose or use under any specific conditions.
- We bind ourselves only to deliver the Products in accordance with the general description under which they were sold.
- We will not have any liability for improper remedy of the Products or Services, alteration of the Products without our prior agreement, addition and insertion of parts or spare parts.
- We shall be under no liability in respect of any defect arising from unsuitable or improper use, defective installation or commissioning by you, fair wear and tear, wilful damage, negligence, defective or negligent handling, improper maintenance, unsuitable operating materials, chemical, electronic or electric interferences, misuse or alteration or repair of the Products in breach of the terms of the warranty.
- Intellectual Property
You shall not remove or alter the trade marks, logos, copyright notices, serial numbers, labels, tags or other identifying marks, symbols or legends affixed to any Products.
Where software applications, drivers or other computer programmes are purchased by you in connection with the order, the use of such Products are subject to the terms and conditions of the licence or use (such as end-user licence agreements) as may be prescribed by the licensors and must not be used other than strictly in accordance with such terms and conditions.
- Standard Return / Refund Policy
- Refund requests are subject to verification that the requests are determined to meet warranty terms requirements and are within the general terms and conditions of purchase.
- Refund process will be initiated only upon receiving returned products for approved product return cases. For lost items in transit, refund processes will be initiated upon customers’ requests for refund and confirmation on missing/untraceable parcels by appointed 3rd party courier services.
- All return charges (courier / tax / duty / stamp / packing) are borne by the buyer.
- Refund process will take approximately 20 working days from the date of refund request approval.
- Monies will be refunded ONLY to the payment method(s) from which payment for the purchase was received.
- Order cannot be cancelled, amended or returned due to a change of mind, wrong product ordered, or incorrect delivery address.
- Shipping & Delivery
Delivery of the Products shall be made to the address you specify in your order by our third party service providers on our behalf.
You agree and acknowledge that delivery of the order is subject to availability of the products. Since the actual delivery of your order can be impacted by many events beyond Uniqbe (M) Sdn Bhd’s control, Uniqbe (M) Sdn Bhd’s cannot be held liable for late deliveries. The estimated shipment date on your order is provided by Apple based on product availability, payment processing time, and warehouse processing time and does not include transit time.
We will make every reasonable effort to deliver the Products to you within the delivery timeframe as stated in your order, but you acknowledge that delivery timeframes are estimates only and delays can occur.
As Apple takes care of the dispatch of the products you purchase on the Site, the risk of loss of, or damage to, product(s) shall pass to you when you, or a person designated by you, acquires physical possession of the product(s). Title in the product(s) shall pass to you when the product(s) is picked up by the carrier from Apple’s warehouse. At this point, you will receive a shipment notification email. Please take note that the carrier will carry out 2 delivery attempts and will hold the product item of your order for up to 7 calendar days for you to contact to arrange for redelivery before returning the item to Apple’s warehouse. Once the item has been returned due to failed delivery attempts or refusal to accept delivery by you, your order will be considered as cancelled with no further redelivery. For such return, Uniqbe (M) Sdn Bhd will charge you a restocking fee of MYR200 per item. The restocking fee will be deducted from the amount of refund that you may be entitled to.
Where we have completed performing the Services or delivered the Products, you will be deemed to have accepted or approved them within seven (5) days from the date of completion of the performance of the Services or delivery of the Products.
- General
Neither party, including our subcontractors, suppliers or software produce developers are liable for any of the following even if informed of their possibility and whether arising from contract, tort (including negligence) or otherwise: (i) Third-party claims for damages; (ii) Loss of or damage to data; (iii) Special, incidental or indirect damages or for any economic consequential damages of any kind; and/or (iv) lost profits, business, revenue, goodwill or anticipated savings.
To the extent permitted by law, in no event shall our aggregate liability arising out of or relating to your order, exceed the total amount paid by you to us for the Products sold or Services provided.
These terms and conditions shall be subject to, governed by and interpreted in accordance with Malaysian laws. The parties irrevocably submit to the exclusive jurisdiction of the Malaysian courts.
